Position Paper on Limitation of Liability

February 10, 2023

The ACEC-BC Business Practice Committee is excited to release an updated version the ACEC-BC Position Paper on Limitation of Liability!

What is the Position Paper on Limitation of Liability?

Limitation of liability clauses are included in agreements between a client and their consultant. The clauses limit a consulting engineer’s risk or financial exposure to liability for claims that may be brought by the client in the event they suffer a loss related to the consultant’s services.

“It’s crucial for Consulting Engineers to understand limitation of liability clauses and seek to include them in client-consultant agreements as a standard practice.

To support members, the Business Practice Committee plans to update other position papers which include topics such as disclaimer clauses, indemnities, termination of contracts, and more.”
